These Terms of Use (the "Terms") are an agreement between you and Work Hard Be Kind (workhardbekind.ai) ("we," "us") governing your use of Work Hard Be Kind, our web platform for real estate professionals, including the modules and features we offer through it from time to time (which may be added, renamed, or retired), our hosted web pages at workhardbekind.ai and its subdomains and any other domain from which we serve the Service, and related features (together, the "Service").
Please read these Terms carefully. They include an agreement to resolve disputes by binding individual arbitration (Section 18), a class action waiver, disclaimers of warranties, and limits on our liability. By accepting these Terms you agree to them; do not use the Service if you do not accept them.
1. Acceptance
You accept these Terms through a recorded acceptance step that presents them — for example, by checking an "I agree" control that references these Terms when you register or first sign in. We record the version of the Terms you accepted and when you accepted, and we can show you that record on request. Acceptance happens only through such a recorded step: we do not treat your use of the Service, by itself, as acceptance of these Terms or of any update to them.
If you accept on behalf of a team or brokerage, you represent that you have authority to bind that entity, and "you" includes it.
2. Who may use the Service
The Service is offered for business use by real estate professionals licensed with Real Brokerage. To use the Service you must:
- be at least 18 years old;
- be an active real estate agent or team member in good standing, or an internal staff member we authorize to operate the Service;
- hold any license required for your real estate activities, or work under the supervision of someone who does;
- use the Service in connection with your real estate business, not for personal, family, or household purposes; and
- comply with your brokerage's policies, and with the terms of any third-party service you connect to the Service (including Real Brokerage and reZEN — see Section 4).
Access to the Service, and to particular modules within it, may be limited to members of a sponsoring team or to accounts we have enabled, and may change over time. The Service is offered for use in the United States.
3. What the Service is (and is not)
What the Service does. Work Hard Be Kind is a bundle of utility tools that supplement the systems you already use through deep integration with reZEN.
What the Service is not. The Service is a software tool that assists you. It is not:
- a system of record. reZEN and your brokerage's systems remain the systems of record; the Service presents a cached, convenience copy of data that may be out of date, and you should verify anything important against the source;
- a licensed real estate broker or salesperson, a law firm, or an accountant, and the Service does not provide brokerage, legal, tax, financial, or compliance advice, or personalized investment advice;
- an official product of, or endorsed or sponsored by, Real Brokerage, reZEN, or any brand or team name shown in the Service. Where the Service displays brokerage or team branding, you are responsible for ensuring you are permitted to use it, and its display does not indicate any affiliation between us and Real Brokerage.
4. Your reZEN connection and API key
Several modules read data from reZEN (the Real Brokerage platform). To enable them you provide your own reZEN API key ("API Key"), or, if you are a team leader, a key whose scope covers your team.
By providing an API Key, you:
- authorize us to use it on your behalf to read your reZEN data (for example, your profile, transactions, commissions, and team roster) for the purpose of operating the modules you use, and to hold a short-lived cached copy of that data solely to run those modules. The cache is refreshed from reZEN, is not kept as a standalone dataset, and is deleted as described in Section 14;
- represent that you are permitted to do so — that the key is yours (or properly delegated to you), that using it with the Service is consistent with Real Brokerage's and reZEN's terms (including any reZEN API terms) and your brokerage's policies, and that you have any authority required to connect it; and
- understand the scope. The Service reads or writes only what your key can access as granted by you when you generate a key in reZEN.
We store your API Key encrypted. You may remove it or disconnect at any time in your settings; doing so stops future reads immediately and starts deletion of your cached reZEN-derived data (Section 14). You are responsible for keeping your API Key valid and for the consequences of the access it grants.
reZEN-derived data. Data we read through your API Key ("reZEN-derived data") is used only to operate the modules you use, for your own real estate business, under your reZEN API license. We act as your service provider in doing so and claim no license to the reZEN API in our own right. We do not combine reZEN-derived data across agents into a retained dataset, do not use it to build databases or products separate from the Service you use, and do not include it in the de-identified data described in Section 8.
Team delegation. If you are a team leader and connect a key that can read your team's data, you direct us to use the key you provide to operate team-level features (for example, a team leaderboard or a leader's production rollup) for members of your team, and you represent that you are permitted to grant that access under your brokerage's policies and each member's reZEN sharing settings. Even so, the Service is designed so that each agent sees only their own detailed records except through the limited, team-level and community-level views described in Section 7.
5. AI features
Some features use artificial intelligence, including image-generation models operated by third-party providers. You acknowledge that:
- AI output can be wrong. Generated images and any other AI output may be inaccurate, incomplete, or unflattering, even when presented confidently. You are responsible for reviewing AI output before you rely on it or use it publicly.
- Generated images. Images the Service generates are created by an AI model from photos you upload; results are approximations, not photographs, and may not depict you or the subject matter accurately. Section 10 covers your rights in the photos and images.
- Humans may review. Our team may review your account, content, and Service activity to provide support, operate the pilot, and keep the Service safe and accurate.
6. Your responsibilities
You agree that you will:
- verify before relying. Treat the data, figures, timelines, and rankings the Service shows as convenience copies, and verify anything important (especially production and commission numbers) against reZEN or your brokerage's systems of record before relying on it or sharing it;
- comply with your professional, licensing, disclosure, fair-housing, privacy, and other legal obligations, and with your brokerage's policies and the terms of the third-party services you connect (including Real Brokerage and reZEN);
- provide accurate information, keep your account details current, and keep your sign-in credentials and API Key secure; and
- not misrepresent the Service, or content it generates, as an official product of or endorsed by Real Brokerage or reZEN.
7. Your Content, others' information, and team visibility
Your Content. "Content" means the information, photos, suggestions, profile details, and other materials you submit to the Service, and the reZEN data you direct the Service to read on your behalf. As between you and us, you own your Content. You grant us a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and display your Content, to compute the views the modules present from it (for example, a production report or a leaderboard), and to generate images from the photos you submit, as needed to provide, secure, support, and improve the Service, consistent with these Terms, our Privacy Policy, and the limits in Section 4.
Other people's information. Your reZEN data and documents routinely contain personal information about other people (for example, your clients and counterparties). You represent that you are permitted to have the Service process that information for the purposes in these Terms.
Team and tenant visibility. The Service is designed so that each agent's detailed data is private to that agent, and wider visibility comes only from limited views deliberately published by agents and team leaders:
- team-level features such as a team leaderboard show a minimal slice of production data — for example, counts, rankings, property addresses, and closed prices — and never client names or contact information;
- where a module lets you publish something to your team or to the wider community of Service users (for example, listing an open house), your act of publishing is your consent to share that limited slice; and
- a team leader may see team-level rollups of their team's production through audited, access-controlled features, using a team key they provide and are permitted to use.
We do not otherwise disclose one agent's data to another. Section 5 of the Privacy Policy describes this in more detail.
8. Privacy and data handling
Our Privacy Policy, published at /privacy and linked from the footer of our pages and emails, describes how we collect, use, and share personal information, and is incorporated into these Terms by reference. In summary, and subject to the Privacy Policy:
- We process Content to run the Service, including through the service providers we use to operate (cloud database, storage, and authentication; hosting; sign-in; email delivery; and AI image generation) and the reZEN platform you connect.
- We do not sell personal information.
- Sensitive fields are protected. Your reZEN API Key and other sensitive identifiers are encrypted, and access between agents and teams is isolated at the data layer.
- De-identified data. We may create and use de-identified or aggregated data (data that no longer identifies you or anyone else) to operate, analyze, and improve the Service, and we will not attempt to re-identify it. This does not include reZEN-derived data, which we do not aggregate or retain beyond the cache described in Sections 4 and 14. We do not use your identifiable Content to train generalized AI models without your consent.
9. Suggestions, feedback, and no ownership or equity
We welcome your ideas. If you submit a suggestion, feature request, comment, vote, or other feedback about the Service (through a feedback feature or otherwise) ("Feedback"), the following applies:
- License to us. You grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable right to use, copy, modify, display, distribute, and otherwise exploit the Feedback, and to develop, make, and commercialize products and features based on it, for any purpose and without restriction or obligation to you.
- No ownership or compensation. Submitting Feedback does not give you any ownership, equity, revenue share, royalty, or other financial interest in us, the Service, or any product, feature, or improvement developed from or inspired by your Feedback; does not create any partnership, joint venture, employment, or agency relationship between you and us; and does not entitle you to any payment, credit, attribution, or confidentiality. You should not send us Feedback you expect to be kept confidential or to be compensated for.
- You have the right to submit it. You represent that you own or have the right to submit the Feedback and that it does not violate anyone else's rights.
- We are not obligated to use it. We may use, modify, or ignore any Feedback in our sole discretion, and we may already be developing similar ideas independently.
10. Photos you upload and your likeness
Some optional features let you upload photos of yourself and generate headshots or marketing images from them. You represent that you own or have permission to use every photo you upload and that the people shown in it (including you) consent to its use in the Service. You grant us the licenses in Section 7 to process those photos to generate images, including sending them to our AI image provider. As between you and us, you may use the images the Service generates for your real estate business; we do not claim ownership of them, and we do not use your uploaded photos or generated images to advertise the Service or for any purpose other than providing it to you, without your consent. You are responsible for how you use generated images, including any disclosure your brokerage or the law requires for AI-generated or edited images.
11. Third-party services
The Service works with third-party services you connect or that we use to operate, including Real Brokerage and reZEN, your sign-in provider, and our service providers. Your use of those services is governed by their own terms, and you are responsible for complying with them. We are not responsible for third-party services, their availability, or changes they make, and features that depend on them may stop working if a third party changes or restricts access.
12. Fees and entitlements
Most aspects of the Service are provided at no charge to agents. Some modules may be offered on a paid or team-sponsored basis; the applicable fees and terms will be presented before you are charged, and no module charges you money without your agreement. Access to a given module is controlled by an entitlement that may be free to your team, self-paid, or sponsored by your team, and may change over time. Any fee is for the software and hosting we provide, not for reZEN-derived data, which is not ours to sell and which we do not package or resell.
13. Acceptable use
You will not, and will not permit anyone to:
- use the Service in violation of law or of your brokerage's, Real Brokerage's, or reZEN's terms and policies;
- provide an API Key or Content you are not permitted to provide, or use the Service to access reZEN or any data in a way your key's scope or those terms do not permit;
- attempt to access another agent's or team's data, probe or test the security of the Service, or circumvent authentication, isolation, or rate limits;
- reverse engineer, copy, resell, or provide the Service to third parties as a service bureau, or use it to build a competing product;
- use automated means to scrape the Service, submit malicious code, or upload content that is unlawful, infringing, or that you lack the right to submit; or
- misrepresent your affiliation with, or the Service's affiliation with, Real Brokerage or reZEN.
We may investigate violations and suspend or terminate accounts involved in them (Section 14).
14. Term, suspension, and termination
These Terms apply from your acceptance until terminated. You may stop using the Service and close your account at any time. We may suspend or terminate your access (with notice where practicable) if you materially breach these Terms, if your account creates security or legal risk, or if we discontinue the Service or your access to it.
On termination, disconnection, or the end of your affiliation with Real Brokerage, your API Key connection ends and future reads stop. Retention then runs on two tracks:
- reZEN-derived data (Section 4) is permanently deleted from the Service within 7 days of the earliest of: your disconnecting your API Key, termination of your account, or our receiving notice that your affiliation with Real Brokerage has ended; and promptly on your request. It is not exported, de-identified, or retained, except for the minimum access and audit records we must keep under law or our Privacy Policy. Please tell us promptly if your affiliation with Real Brokerage ends.
- Your other Content (for example, photos, generated images, suggestions, and profile details) may be exported at your request for a period of 30 days after termination, after which we may delete it, except for records we retain under our Privacy Policy or as required by law.
Sections that by their nature should survive (including Sections 7 through 10 and 15 through 20) survive termination.
15. Disclaimers
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA, FIGURE, RANKING, OR GENERATED IMAGE WILL BE ACCURATE OR COMPLETE. PRODUCTION, COMMISSION, AND OTHER FIGURES ARE PRESENTED FOR YOUR CONVENIENCE FROM CACHED DATA, ARE NOT THE SYSTEM OF RECORD, AND ARE NOT GUARANTEED.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) NEITHER WE NOR OUR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST COMMISSIONS, LOST BUSINESS, LOSS OF GOODWILL, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR US $100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW. THE PARTIES INTEND THESE LIMITS TO APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
17. Indemnification
You will defend, indemnify, and hold harmless us and our owners, managers, employees, and agents from and against claims, damages, and expenses (including reasonable attorneys' fees) arising out of: (a) your Content and the photos and Feedback you submit; (b) your use of an API Key or of reZEN data, including any claim that you were not permitted to connect the key or to have the Service access that data; (c) your professional acts or omissions; or (d) your breach of these Terms or violation of law or of a third party's terms (including Real Brokerage's or reZEN's). We will give you prompt notice of the claim and reasonable cooperation at your expense; we may participate in the defense with our own counsel.
18. Dispute resolution: binding arbitration and class action waiver
Please read this section carefully. It affects your rights.
Informal resolution first. Before filing a claim, each party agrees to give the other written notice of the dispute and 30 days to resolve it informally.
Binding arbitration. Any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by final and binding arbitration administered by JAMS under its applicable Streamlined or Comprehensive Arbitration Rules, before a single arbitrator, seated in San Luis Obispo County, California. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction. Each party bears its own attorneys' fees except where the applicable rules or law provide otherwise.
Exceptions. Either party may (a) bring an individual claim in small claims court, or (b) seek injunctive or other equitable relief in court for infringement or misuse of intellectual property or for breach of Section 13 (acceptable use) or the security or isolation of the Service.
Class action waiver. Disputes will be resolved only on an individual basis. Neither party may bring or participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court, and the rest of this section remains in effect.
19. Changes to these Terms
We may update these Terms. You are bound by the version you accepted until you accept an updated version. If we make a material change, we will notify you (for example, by email or through the Service) and ask you to accept the updated Terms through a recorded acceptance step, and we may limit some or all of the Service until you do. Non-material updates take effect when posted with a new version number. The version you accepted and when you accepted it are always recorded. Changes do not apply retroactively.
20. General
- Governing law. These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs Section 18.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate, to an entity formed to operate the Service, or in connection with a merger, acquisition, reorganization, or sale of assets, with notice to you; such an assignment does not require your re-acceptance.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement about the Service and supersede prior discussions.
- Severability; waiver. If a provision is unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control (including outages of third-party services described in Section 11).
- Notices. We may notify you by email to your account address or through the Service. You may notify us at team@workhardbekind.ai.
